Claims that big US airlines colluded to exploit their customers via unfair pricing tactics prompted the establishment of a compensation fund with a minimum of sixty million dollars. The four largest U.S. commercial passenger airlines were first the targets of a class action lawsuit. Here is a list of these carriers:

US Domestic Airlines Price Fixing Class Action Settlement 2024

There has been no resolution to the domestic airline class action lawsuit or settlement as of May 2024. This is because in 2021, United and Delta Air Lines filed for summary judgement in an effort to get the court to dismiss the lawsuit against them. On September 12, 2023, however, the court rejected their request and allowed the case to proceed. This lawsuit ended in victory for the passengers who had sued the airlines.

Airline companies like Delta and United will not back down so easily. Currently, they are requesting permission to appeal the ruling that refused their summary judgement application. The class counsel has opposed the motion, and the court is currently considering whether to accept the appeal.

An explanation on those who will not be receiving settlement funds: Also, the court has approved the class action lawyers’ representation of the plaintiffs in the domestic airline class action lawsuit, even though they do not represent any of the people who were outside of the settlement classes for Southwest and American Airlines.

The exclusions extend to all court employees involved in the administration of justice, including but not limited to judges, court workers, law clerks, and anyone else involved in the litigation. Their status as “agents” of the court dictates that this must be the case.

United and Delta are involved in US Domestic Airlines Price Fixing Class Action, and they are both requesting that the court reject the case altogether. However, the class members will not get the funds from the other airlines’ settlement until this dispute is finalised, which might happen a maximum of once:
1. An agreement was struck between United and Delta.

2. United and Delta are no longer parties to the litigation.

3. As an alternative, if the trials for United and Delta are also successfully concluded.

All of the airlines listed above, plus US Airways and Continental Airlines, were originally named as defendants in a class action lawsuit that claimed the aforementioned airlines engaged in price fixing by monopolising the market and conspiring to artificially and maliciously limit domestic flight capacity, thus increasing fares and artificially and agreeably gouging their customers. The remaining sixty million dollars in settlement payments owed by the airlines are still the subject of ongoing litigation. Right now, people are arguing about the deal.
